In short

WhenLoop is a free tool provided as it is. Use it lawfully and kindly, you're responsible for what you post, and always confirm important plans directly with the people involved.

These terms are an agreement between you and Leon Neal, who runs WhenLoop (“we”, “us”). They apply whenever you use whenloop.com or the WhenLoop app, whether you create a poll, answer one or have an account. By using WhenLoop you accept these terms. If you don't accept them, don't use WhenLoop.

1. The service

WhenLoop is a free tool for creating scheduling polls, sharing them and collecting answers. We may change, suspend or stop WhenLoop, or any part of it, at any time. We'll try to give reasonable notice of significant changes where we can.

If paid features are introduced in future, they will be optional and covered by separate terms that you'll see before paying.

2. Who can use it

You must be at least 13 to create an account. If you use WhenLoop for an organisation, you confirm that you're authorised to accept these terms on its behalf, and “you” includes that organisation.

3. Your account

You're responsible for keeping access to your email account (and any password you set) secure, and for activity under your account. Tell us at support@whenloop.com if you think someone else has used it.

4. Your content

You keep ownership of anything you add to WhenLoop, such as poll details, names, answers and comments (“your content”). You give us a free, worldwide licence to store, copy and display your content as needed to run WhenLoop. You confirm that you have the right to share your content and that it complies with these terms.

You're responsible for your content and for how you use WhenLoop. If you collect other people's personal data through a poll (for example, email addresses), you're responsible for doing so lawfully. We don't check content before it's published and aren't responsible for content posted by others.

5. Acceptable use

You must not use WhenLoop to:

  • break any law, or infringe anyone else's rights;
  • harass, threaten, deceive or impersonate anyone;
  • post anything unlawful, hateful, violent, sexually explicit or defamatory;
  • send spam, unsolicited messages, scams or phishing links;
  • collect personal data without a lawful reason;
  • attempt to access accounts or data you're not allowed to, interfere with or overload WhenLoop, get around its security or limits, or use automated tools to scrape or abuse it;
  • copy, sell or reuse WhenLoop's design, code or content without permission.

We may remove content, restrict features, or suspend or close accounts at any time if we reasonably believe these terms have been broken, or to protect WhenLoop, its users or anyone else. We may report illegal activity to the authorities.

6. Our rights

The WhenLoop name, logo, design, software and website content belong to Leon Neal. These terms don't give you any rights to them other than to use WhenLoop as intended.

7. No guarantees

WhenLoop is provided free of charge, “as is” and “as available”. To the extent the law allows, we make no promises that it will be available, uninterrupted, secure, error-free, or suitable for your purposes, or that information on it (such as times, time zones, answers or emails) will be accurate or delivered. WhenLoop helps you organise; it doesn't replace confirming important arrangements directly with the people involved.

8. Limits on our liability

Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded by law. Nothing in these terms affects your statutory rights as a consumer. Subject to that:

If you use WhenLoop personally: we're only responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill. We're not responsible for loss or damage that wasn't foreseeable, that was caused by your content, other users' content or your breach of these terms, or that was caused by events outside our reasonable control (such as outages of internet or service providers). WhenLoop is for personal use, so we're not responsible for any business losses, such as lost profit, business or opportunity.

If you use WhenLoop for business: we're not liable for any loss of profit, revenue, business, opportunity, goodwill or data, or for any indirect or consequential loss, and our total liability for all claims relating to WhenLoop is limited to £100.

9. If you use WhenLoop for business

If you use WhenLoop for an organisation or business, you agree to cover any reasonable losses, costs and claims we face because of your content, your use of WhenLoop or your breach of these terms, including claims from people whose data you collected.

10. Ending your use

You can stop using WhenLoop at any time and delete your account in Settings. Sections 4 (the licence ends when your content is deleted), 6, 7, 8, 9 and 13 continue to apply after you stop.

12. Changes to these terms

We may update these terms from time to time, for example to reflect changes to WhenLoop or the law. The date at the top shows when they last changed. If you keep using WhenLoop after a change, you accept the updated terms.

13. General

  • If any part of these terms is found to be unenforceable, the rest still applies.
  • If we don't enforce a right straight away, we can still enforce it later.
  • These terms are the whole agreement between you and us about WhenLoop.
  • Nobody else has any rights under these terms.
  • We may transfer our rights and obligations under these terms to another person or organisation, for example if WhenLoop becomes a company.
  • These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you're a consumer living in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
